Perak assembly Speaker, V Sivakumar, has summoned Barisan Nasional Menteri Besar Zambry Kadir and his executive councilors to answer charges before the Committee of Privileges of having violated House rules by taking over the state government through unconstitutional means.
“After studying the complaints I received from the Canning assemblyman, Wong Kah Woh, the committee in which I chair has found that there is a prima facie basis for the complaint,” said Sivakumar.
“As such, the committee has unanimously decided to refer all seven to the Committee of Privileges under the House standing order number 72.”
Unconstitutional means
Under standing order 72 (3), the Committee of Privileges has the power to summon those believed to have violated House regulations and rules.
The Canning assemblyman had on Friday filed a complaint against Zambry, accusing him and the BN of taking over the Perak state government by unconstitutional means.
Wong also wants Zambry to explain “under which provision of the Perak Constitution do they base their right to form the state government.”
If found guilty by the seven-member Committee and if the findings are also endorsed by the state assembly - Zambry and his exco line-up face being suspended or even expelled.
Said Sivakumar: “Only the state assembly can decide on what to do with them. Right now, what I need to do is to inform Zambry and the other six that they will be referred to the Committee after I found the complaint made by the Canning assemblman to have a strong basis.”
BN has the same number of 28 seats as arch enemy Pakatan Rakyat in the Perak state assembly.
There are three Independents, former Pakatan assemblymen who have since declared their backing for the BN, although they have right to abstain or even join in the vote against the BN.
